Sikash Terms of Service

1 Eligibility

• Be at least 18 years old
• Have a valid email address and phone number
• Complete identity verification if requested
• Be legally capable of entering into contracts

We reserve the right to reject or suspend any account at our discretion.

2 Overview of Services

• Create a unique payment page using a personal username
• Receive payments via mapped virtual accounts
• Hold balances in a digital wallet
• Withdraw to a verified local bank account
• Earn optional ad revenue from traffic to their page

3 Account Creation and Verification

• Provide accurate personal and banking information
• Use your real name (matching government ID or BVN)
• Complete full KYC to activate withdrawals
• Maintain only one Sikash account
• All payouts must be made to a bank account owned by the verified user.

4 Platform Fees & Revenue Model

A 4% processing fee is charged on each successful transaction. This is automatically deducted from your balance.

• Sikash receives 60% of gross ad revenue
• You receive 40% of gross ad revenue
• Revenue is calculated based on impressions, clicks, or engagement as reported by ad networks
• Sikash reserves the right to change the revenue share with 30 days’ notice

5 Wallet & Withdrawals

• Ledger Balance: Total incoming funds (including pending)
• Available Balance: Funds cleared after 3 business days

• Available once KYC is complete
• Processed to verified local bank accounts
• Subject to review for fraud, AML, or compliance risks
• We may temporarily hold or freeze funds under investigation or upon request by law enforcement or banking partners.

6 Acceptable Use

You agree not to use Sikash for:

• Fraudulent or illegal transactions
• Sale of prohibited goods or services (e.g., drugs, weapons, explicit content, gambling)
• Money laundering or terrorism financing
• Harassment, defamation, or impersonation

7 Advertising Content & Earnings

• Sikash selects and displays ad content
• You will not receive personal user data from ad interactions
• Sikash cannot guarantee consistent ad earnings
• Sikash may disable ads at any time for any reason
• Creators are prohibited from manually inflating clicks or engagement to manipulate earnings.

8 Platform Evolution

We may introduce new features over time, including:

• Tip jars, cards, cross-border payments, referral programs, or additional wallet functions.

New features may be governed by separate terms, policies, or user agreements, which will be communicated accordingly.

9 Intellectual Property

All Sikash software, branding, trademarks, and design elements are owned by Sikash and protected by intellectual property laws.

You retain full ownership of content you upload (e.g., profile image, description), but grant Sikash a license to display, promote, or publish it in connection with the service.

10 Dispute Resolution & Reversals

• If a user disputes a transaction (e.g., claims fraud), we may:
• Investigate and reverse the payment if necessary
• Notify both parties
• Freeze affected balances during the investigation
• Disputes should be raised via support@usesikash.com within 7 days of the transaction.
• All decisions made after investigation are final and binding unless new material evidence is presented.

11 Termination of Account

• We reserve the right to terminate or restrict access to your account at any time if:
• You breach these Terms
• Your documents are falsified or unverifiable
• There is evidence of suspicious or harmful activity
• Required by legal or financial partners
• You may close your account anytime by contacting support@usesikash.com. Residual balances may be subject to review and held for up to 30 days in fraud cases.

12 Limitation of Liability

• To the extent permitted by law:
• Sikash is not liable for lost profits, indirect damages, or delays in service
• We are not liable for actions of third parties (e.g., payment processors, ad networks)
• Earnings from transactions or ads are not guaranteed
• You use the platform at your own risk. While we do our best, no service is 100% immune from technical issues or downtime.

13 Force Majeure

• We are not responsible for delays or failure to perform caused by:
• Natural disasters, war, strikes, internet outages, power failure, civil unrest, or changes in law

14 Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria, specifically under the jurisdiction of the Lagos State High Court.

15 Arbitration Clause

If a legal dispute arises and cannot be resolved amicably, both parties agree to resolve the dispute through binding arbitration in Lagos, Nigeria. Each party will bear its own legal costs.

16 Compliance with Privacy & Data Laws

• Sikash operates in compliance with:
• NDPR (Nigeria Data Protection Regulation)
• GDPR (European Union) when handling international users
• Data collected is used strictly as described in our Privacy Policy.

17 Updates to These Terms

• We may revise these Terms at any time. When we do, we will notify users via:
• In-app banner
• Email
• Or homepage alert
• Continued use of the platform after notice means you accept the revised Terms.
